1. About these terms
These terms apply when you use the Kalon apps for macOS, iPhone and iPad, Air Kalon, AirLink, the kalon command-line tool, and this website (together, the "Services"). They are an agreement between you and Kalon ("we", "us"). By using the Services you accept these terms. If you do not accept them, do not use the Services.
2. The software and its licences
Kalon is free to download. Parts of the Services are published as open source, including the Rust core of Kalon, Air Kalon and AirLink, which are released under the MIT License. Where a component comes with its own licence, that licence governs your use of that component, and nothing in these terms limits the rights it gives you. For everything else, we grant you a personal, non-exclusive, non-transferable licence to install and use the apps on devices you own or control.
The Kalon name and marks are ours. Open-source licences do not grant any right to use them.
3. Models
Kalon runs open-weight models made by other organisations, which you download from third-party hosts such as Hugging Face. Each model is licensed by its publisher under its own terms, some of which restrict commercial use or certain kinds of use. You are responsible for reading and following the licence of every model you download. We do not own these models and make no promise about what they produce.
4. Your content and the output
Your prompts, files, conversations and the output the models produce are yours. They stay on your devices, and we receive none of them, so we claim no rights in them.
Models can be wrong, incomplete or out of date, and can sound confident when they are wrong. Output is not professional advice. Check anything important, and do not rely on the Services for medical, legal, financial or safety decisions.
5. Agent mode, tools and Build mode
In agent mode and Build mode, Kalon can run commands, read and change files, and use tools and MCP servers that you enable. You decide what the assistant may do, and you remain responsible for the actions it takes on your behalf. Keep backups of anything important, review changes before you rely on them, and only connect tools and servers you trust.
6. Online providers and other third parties
Online models, realtime voice and MCP servers are run by third parties. They are off until you set them up, usually with your own account and API key. When you use them, your agreement with that provider governs what you send to it, any charges it makes, and how it handles your data. We are not responsible for third-party services.
7. Local servers and your network
The Local API server and Kalon Link are off by default. The local API has no authentication, so if you turn on its Network access, anyone who can reach your Mac on that network can use your models. You are responsible for turning these features on only on networks you trust.
8. Family profiles
Family profiles help a parent give children a restricted assistant on a shared device. They do not filter replies for content, and they do not replace supervision. If you create profiles for children, you are responsible for their use of the Services.
9. AirLink is not an emergency service
AirLink carries messages and calls between nearby devices without a mobile network. Delivery depends on range, on other devices nearby, and on battery and radio conditions, and it can fail. AirLink cannot contact emergency services. Do not rely on it for emergency communication.
10. Acceptable use
Do not use the Services:
- to break the law, or to infringe anyone's rights, including the licences of the models you run
- to harm, harass or deceive people, including by passing off generated content as human-made where disclosure is required
- to break into, disrupt or overload systems and networks you are not authorised to use
- to operate systems where a failure could cause death, injury or serious damage, unless you add your own independent safeguards
11. Changes to the Services
We improve the apps continuously. Features may change, move or be removed, and some are marked as coming soon or in development. We may stop offering a version of the Services, but the copies you have installed keep working as they are.
12. Disclaimer
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising from your use of the Services. Because the Services are provided free of charge, our total liability for any claim is limited to the amount you paid us for the Services in the twelve months before the claim, if any. Nothing in these terms limits liability that cannot be limited by law.
14. Ending these terms
You can stop using the Services at any time by deleting the apps. If you seriously breach these terms, your licence under section 2 ends. Sections 3, 4 and 12 to 16 continue to apply after these terms end.
15. Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed, and significant changes will be announced on this site. If you keep using the Services after a change takes effect, the updated terms apply.
16. Governing law
These terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction over any dispute, unless the law where you live gives you the right to bring a claim in your local courts.
